Before each new call, young people who fall under it ask questions about how to postpone the start of the service or avoid it altogether. There are many ways to solve this problem. They can be both legal and not entirely legal, which consist in trying to pay off money through employees of the military commissariat.

Some conscripts receive a deferment from military service on legal grounds, which are quite numerous in the current Federal Law No. 53 of March 28, 1998 “On Military Duty and Military Service”. The law specifies the order in which military service should take place, and article 24 of the 53-FZ defines the categories of young people who are subject to exemption from service.

The following persons of military age fall under this definition:

1) Young people whom the military medical commission has recognized as limited fit for service.

To obtain such a decision, the conscript must undergo a medical examination at the military registration and enlistment office at the place of residence.

If there is at least one of the chronic diseases included in the list of diseases in which a young person has the right not to serve in the army, he must provide the commission with documents confirming this right - a medical card, various certificates, preferably obtained from a state medical institution, and not in a private clinic. This category of citizens is issued a military ID when they turn 18 years old.

2) Citizens who intend to do alternative service.

Those who wish to replace military service with alternative service must submit an application to the military commissariat at the place of permanent registration with a convincing description of the reason. Most often, religious affiliation is indicated, which does not allow serving, or the principles of morality, morality. The term of such service is longer (from 18 to 21 months) than with urgent conscription.

A young man who does not have a higher education during this period is engaged in unskilled and low-paid work. Most often, these are the duties of a nurse in a hospital or a worker at various production facilities. As a rule, work is provided far from home, and the salary is insignificant.

Citizens with higher education are waiting for work in libraries, archives, office work, which is paid minimally. It is possible for them to work in their specialty (engineer, doctor, teacher, etc.), but also with a small pay.

3) Citizens who have served in a foreign state with whom Russia has an international agreement on this matter.

  • citizens with academic degrees of candidates, doctors of sciences;
  • brothers and sons of conscripts who died in the army or during military training;
  • persons with an outstanding conviction, serving a prison sentence, who are in a colony, under investigation.

Other cases of deferment from service

Deferment from the army 2017 also valid in other cases, which are stipulated in article 24 of the Federal Law "On military service". According to it, citizens receive a deferment due to various circumstances: poor health, difficult family circumstances, the need to continue their studies, in connection with work in certain organizations, and others.

For health reasons, persons who are temporarily unfit for military service, recognized as such upon the fact of a medical examination, have the right to deferment (the conscript is assigned a category of fitness for service “G”, the delay lasts no more than 1 year).

Postponement for family reasons

Citizens of draft age can legally postpone service:

  • having 2 or more children, a child with a disability under 3 years old;
  • if they are single parents (raising children without their mother);
  • being the sole official guardian (custodian) of brothers, sisters of minor age in the absence of other adult relatives of these children.
  • having a child and a wife with a pregnancy of 26 weeks;
  • caring for sick relatives in the absence of other family members (if the conscript is the only breadwinner in the family).

Postponement from military service upon employment

The deferment applies to young people subject to conscription who have graduated from a higher educational institution and are employed in state bodies according to their profile. These are organizations such as the fire service, the Ministry of Emergency Situations, the Ministry of Internal Affairs, the penitentiary service, customs authorities, the control service for the circulation of psychotropic substances and drugs.

Deferment from service is granted to citizens who are elected as deputies to federal, regional authorities or registered as candidates for elective office. It is valid until the moment when the election results are made public (in case of early withdrawal, a delay is given until this day inclusive).

Most often, young people use the deferment for higher education at the budget and commercial department.

Only full-time full-time students can use it. Educational institutions must be state accredited. The deferral is given in accordance with the term of study, for its entire period.

The right to deferment is retained by students on academic leave or expelled at their own request. If a young person studies until the age of 27 (the maximum draft age) - from undergraduate to postgraduate full-time studies, then he will automatically be exempted from conscription for military service.

One deferment for the period of study is also given to students of day departments of secondary educational institutions (colleges, technical schools, technical schools) with state accreditation, if they do not have a completed secondary education.

Postponement by Presidential Decree

In 2012, Decree of the President of Russia No. 969 was issued, according to which clergy can receive a deferral at the request of religious organizations.

To do this, they must receive a spiritual rank, hold a leadership position for working with believing military personnel, and undergo special training for the performance of their duties. The deferment will be in effect for the duration of this position. Up to 150 people are allowed per year.

What can you do to get a deferment and what should you refuse

Some conscripts try to deceive the medical board by feigning non-existent mental disorders or other illnesses that preclude military service. From January 1, the law removes the time frame. Now college students can get an education without worrying that the deferment will end before graduation. Now temporary exemption from the army is granted for the entire period of mastering educational programs.

How to get a deferral at a university (Bachelor's degree)

In the event that a recruit, on the basis of a university order, is enrolled in a state-accredited educational program, he also has the right to deferment for the period of study at a higher educational institution.

It is important to note that university students are not granted a deferment from the army for distance learning. It does not give the right to temporary exemption from conscription and full-time education. Deferment from the army is guaranteed only to those students who entered the full-time form.

To apply for it, the student needs to register with the military registration desk of the university, for which the following documents must be submitted:

  • The passport.
  • Student ticket.
  • Attribution certificate.

After that, the conscript must take a certificate from the dean's office of the university stating that he is really a student of the university. The certificate must indicate:

  1. Date and number of the enrollment order
  2. Estimated date of graduation
  3. Current course of study

With this certificate, as well as with a registration certificate, recruits must come to the military registration and enlistment office and undergo a medical examination, and then receive a decision from the draft commission on granting a deferment.

Remember that only the military registration and enlistment office, and not the leadership of the educational institution, can release a young man from conscription. It must also be taken into account thatmilitary department and respite from the armyare not considered by law in a single context. Military training does not provide additional benefits to the student. Therefore, if a young man does not have a deferment, then studying at a military department will not become a guarantee of temporary exemption from conscription.

How to get a deferral at a university (Master's)

In order to receive another deferment after the completion of the undergraduate degree, several prerequisites must be met:

  • Full-time education, state accreditation of the educational program of the magistracy.
  • Continuity of the educational process. You need to enter the magistracy in the year of graduation from the bachelor's degree, without any breaks.

There is a widespread belief that it is possible to enter a master's program only in the university in which the student studied for a bachelor's degree. However, this is not the case: if the above conditions are met, then you can choose any magistracy for admission.

It is important to bear in mind that a delay for admission to the magistracy is provided only if a citizen graduated from school before reaching the age of 18. Young people who have reached the age of majority while studying in 11th grade are granted a deferment only for undergraduate admission.

Postgraduate studies

If, after graduating from the magistracy, the conscript has a desire to continue his studies, then he can enroll in graduate school and thus receive another deferment from conscription. Postgraduate studies give a deferment from the army for the entire period of study (usually 3 years). In addition, after graduation, the applicant is given 1 year deferment to defend the thesis.

Note! The number of deferrals for admission to graduate school is not limited by law. Thus, upon expulsion, you can once again enroll in graduate school and again receive a deferment.

Repeated postponements

As a rule, a deferment from conscription is given to a conscript 1 time. However, there are several exceptions to this rule:

  1. In the event that the conscript received the first deferral for admission to a university after school, he can apply for a second one for undergraduate studies
  2. If in the year of graduation from the bachelor's degree the conscript enters the master's program, then the right to deferment will remain
  3. After graduating from the magistracy, the conscript can enter the graduate school and he will be granted a deferment
  4. If the conscript expelled from graduate school, but then re-entered, then the deferment will be issued again

As you can see, the main criterion that allows you to temporarily get rid of the service again and again is the continuity of the educational process. If a conscript enters a new educational institution in the year of graduation of the previous one (provided that each new institution is a new stage of education), then he can safely use deferrals until the end of the military age.

An important point: a prerequisite for granting a deferral is training in an educational program that has state accreditation. In the event that the program (or the educational institution as a whole) does not have accreditation, the conscript will not be granted a deferral. For the second higher deferment from the army is also not provided.

How to keep the delay?

The legislation also provides for several opportunities to take a break in training, but at the same time retain the right to deferment.

  • If a conscript has made a transfer from his university to another (and also transferred within the university, changing, for example, the training program), the delay will remain with him if the total period of study increases by no more than 1 year or remains unchanged.
  • If a student has taken an academic leave for a period of one year or less, then upon returning to the educational process, he will retain the deferral
  • If the student expelled of his own free will (and not at the initiative of the educational institution), then after the restoration in the educational institution, he will restore the deferment if the total period of study in the educational program does not increase.

Deferment from the army is a certain period of time during which a fit-for-military conscript cannot be called up for urgent military service. Deferment from the call for study

This type of deferral includes young people studying at school (secondary education), college or technical school (secondary vocational education), higher education institution or continuing to receive education immediately after graduation. An important aspect is full-time education and state accreditation, since deferrals do not apply to non-accredited educational institutions. In addition, the study deferral applies to graduate students and persons who have defended their Ph.D. thesis and received the title of Candidate of Sciences.

1. A deferment for schoolchildren is granted until they reach the age of 20. At the same time, education must take place in person and according to a special list of approved programs for education (meaning ordinary public secondary schools):

If you successfully pass the final exams (state final certification, no retakes) after mastering the general program of the educational institution (graduation of 11 classes), for the period until the end of September of the current year (meaning the year the certification was passed), the student has the right to defer;

Students studying in colleges or technical schools are exempt from conscription for military service for the entire period of study in this institution;

Students studying in colleges or technical schools on the basis of incomplete school education, that is, having completed not 11, but 9 classes, the student has the right to a deferment until the age of 20, it does not matter whether the planned course of study is completed.

2. Postponement for students of a higher educational institution is granted only to full-time students. In this case, the deferral will be valid until the end of the full course of study if and only if the right to deferment while studying at school has not been previously used. This means that after graduation, you must be enrolled in a higher educational institution before October 1 of the current year. 3. The deferment is granted to graduate students who are undergoing a postgraduate educational program in accordance with the approved standards, and are enrolled in full-time education. The deferment applies to the full course of study, as well as to the period during which the postgraduate student will prepare and defend the final qualifying work. But this period cannot be more than one year from the end of the course of the educational program.

4. When studying full-time in a state accredited educational institution, you have the opportunity to go on academic leave for a period of not more than 1 year, while the total period of study must remain unchanged or also increase by no more than a year. Under such conditions, the right to deferment from the army is preserved.

5. Changing the specialty within the framework of training in the same educational institution, which does not entail an increase in the period of study or increases it for a period of not more than one year, retains the right to deferment from the army for study.

It is important to remember that in order for the deferment from the army to take effect, it must be implemented. If there are violations when granting the first deferment for study (violation of the regulations), then this fact is interpreted from a legal point of view as the right to deferral, which was not exercised by you. Postponement for family reasons

A person who is raising his own child without the participation of his mother;

A person raising more than one child;

A person who is accommodating a disabled child under the age of 3 years inclusive;

A person engaged in constant care for his mother or father, as well as other close relatives (brothers, sisters, grandparents), in the event that guardianship is carried out by law (decision of social or other bodies);

A person who is the guardian of a brother or sister who has not reached the age of 18, in the absence of the possibility of guardianship over them by more distant relatives. This provision must also be documented.

Pregnancy of the wife for a period of more than 26 weeks.

Deferment for family reasons

A person raising a child without a mother must submit a certificate confirming the composition of the family, a birth and divorce certificate, as well as a document confirming the court decision that the child will be further raised without the presence of the mother;

It is enough for a person raising more than 1 child to submit a certificate of family composition and a birth certificate for each of the children;

A person raising a disabled child from 0 to 3 years old inclusive must present at the military enlistment office a certificate of family composition, a certificate from a state medical institution, according to which the child is recognized as disabled, and a birth certificate;

When the wife is pregnant, for a period of at least 26 weeks, it is necessary to provide a marriage certificate and a conclusion of a medical organization on the gestational age to the military registration and enlistment office;

When caring for a loved one, a package of documents is required, consisting of a birth certificate of a conscript; information about the composition of the family; when caring for a grandmother or grandfather, birth certificates of the father and mother of the person called up for military service; it is enough for persons who are adoptive parents to provide a relevant court decision; the conclusion of a special medical and social commission proving the need to care for a relative; passports of people in need of constant care.

The delay due to guardianship is proved in the military registration and enlistment office by a document authorizing guardianship; birth certificate of both the person called up for service and the person under guardianship; certificate confirming the composition of your family.

Delay for health

During the passage of the medical commission at the military registration and enlistment office, it may be established that the conscript is temporarily unfit, partially fit or not at all fit for urgent military service. When establishing the status of "temporarily unfit" (category "G"), a deferment is granted for health reasons for a period of six months to one year inclusive. Almost every year the list of diseases is revised, therefore, before passing the medical commission, it is better to familiarize yourself with the list that is valid for the current year (the so-called “schedule of diseases”).

Deferment from the army for work

Work in the police department, the state fire service, the criminal and / or executive system, customs, the authorities responsible for controlling the illegal circulation of drugs and / or psychotropic substances after graduating from a specialized educational institution gives the right to a deferral for the duration of the employment contract;

Registration as a candidate for deputy, upon vacating a position in the State Duma of the Russian Federation or regional and / or local governments in accordance with the current legislation of the Russian Federation, gives the right to a delay until the day the official election results are announced;

Execution of documents for granting deferrals to deputies and employees of state structures

When working in state structures (Department of Private Security, Federal Security Service, Ministry of Emergency Situations and others), the military commissariat will require a diploma of graduation from a special specialized university and a certificate from the place of work confirming your rank, position and duration of the employment contract or contract;

When registering as a candidate for deputy, it is necessary to submit a document confirming registration for participation in elections or a certificate from a state body, if the candidate for deputy was elected to the relevant authority.

Postponement granted by direct decree of the President of the Russian Federation

Such a delay is given to those citizens, the decree on the provision of which is signed personally by the President of the Russian Federation. Accordingly, the right to delay is the presence of a decree. Registration of this type of deferral occurs upon presentation of a diploma of education (the need for presentation is additionally indicated in the text of the decree), a certificate from the place of work endorsed by the head. Also, a presidential decree can single out a whole group of citizens, according to the state quota. Every student in an ordinary secondary school until the age of 20 is given a deferment from the army. Why under 20? I think that this is in case the student stays for the second year a couple of times.

In addition, if you have successfully passed the school final exams (USE) and plan to enter a higher educational institution, then you are also granted a deferment. Valid until October 1 of the current year. From my own experience, I can say that this time is enough.

If you enter a college or technical school for full-time education, but at the time of admission you completed only 9 classes instead of 11 at school, then you should be given a deferment from the army until you reach 20 years old for the entire period of study.

IMPORTANT! This also applies to university studies. If, after receiving a deferment, you are expelled from an educational institution in the 1st, 2nd, or any other year, your deferment "burns out".

Postponement for students

If you successfully enter a higher education institution for full-time study, the university must grant you a deferment for the entire period of study. Just don’t think that if you received a deferment in the 1st year, this means that the next 4 years (and I remind you that now all universities have switched to a bachelor’s system of education) the military registration and enlistment office will not touch you. Upon receipt of a deferment, a student must report to the military registration and enlistment office every year and confirm his status and the fact of studying in this educational institution.

IMPORTANT! Postponement of their students can provide educational institutions with state accreditation. There are cases when in one educational institution there are specialties with and without state accreditation. So be careful with this moment!

Graduate Deferral

Postgraduate study deferment is granted to all full-time students enrolled in postgraduate studies for the period of study in postgraduate studies and no more than one year after, in order to defend the candidate's thesis. The latter is given only when necessary in each particular case.

You will retain the right to a deferment from the army if, after taking an academic leave, the total period of study increases by no more than 1 year.

Translation

If you are transferred from one specialty to another or to another educational institution and the total period of study does not increase, or increases by no more than 1 year, then the deferment from the army remains with you.

IMPORTANT! The transfer must also be carried out to a specialty that has state accreditation, otherwise the delay will “burn out”.

Second resignation from the army

If you have been granted a school deferment (11 grades), then you can receive a second deferral of study for undergraduate and specialist programs. Roughly speaking, you can get a second deferral at the university.

If the first deferment was given due to admission to a bachelor's program, then the second may be given due to continuing studies in a master's program.

In other cases, a second deferral is not granted.

Postponement for family reasons

Postponement of the birth of a child

A deferment from conscription for military service is granted to citizens:

- having a child and raising him without a mother;

- having two or more children;

- having a disabled child under the age of three;

Deferment from the army due to the wife's pregnancy

A deferment from the army due to the wife's pregnancy is granted to citizens who have one child and a wife whose pregnancy is at least 26 weeks.

Thus, the main conditions for obtaining a deferment from the army for the wife's pregnancy are:

  • be officially married;
  • have one common child with his wife;
  • the wife's pregnancy must be at least 26 weeks;

Deferment from the army to care for relatives

The main conditions for obtaining a deferment from the army for caring for relatives are:

  • the absence of other citizens obliged by law to support a citizen;
  • the lack of full state support for the citizen who will be cared for;
  • a citizen needs, according to the conclusion of the federal institution of medical and social expertise, constant outside care;
  • a citizen in need of care is your father, mother, wife, brother, sister, grandfather, grandmother or adoptive parent.

Deferment from the army by guardianship

A deferment from the army on guardianship is granted to a citizen if he is the sole guardian or trustee of minor sisters or brothers.

Delay for health

A deferment for health reasons is given to a citizen who is declared unfit for military service (fitness category "G"). The deferment period is from 6 months to 1 year, depending on the severity of the injury due to which the deferment is granted.

Deferment from the army for work

Postponement from the army for work in the Ministry of Emergency Situations, the Department of Internal Affairs and the FSB

The main conditions for obtaining a deferment for work in the Ministry of Emergency Situations, the Department of Internal Affairs and the FSB are:

  • entering the service immediately after graduation from educational institutions of higher professional education of the same bodies and institutions;
  • availability of higher professional education;

Postponement from the army for work as a deputy

All that is required of a citizen in order to receive a deferment from the army for work as a deputy is:

2. He receives a general (in schools, lyceums and other educational institutions) or professional (in schools, technical schools, colleges, universities, postgraduate studies, residencies, adjunctures, etc.) education. At the same time, when receiving a general education, a citizen has the right to a deferral only until the age of 20, and when receiving a professional (except postgraduate) education - only for the period of validity of the standard terms for mastering basic educational programs.

3. He is trained full-time (and no other) form. In addition to students of educational institutions of a number of special bodies and services.

4. He did not exceed the limit of two deferrals (the limit does not apply to those receiving postgraduate professional education and studying in educational institutions of some special bodies and services).

Pupils who for some reason "delayed" in a general education school (or lyceum) up to the age of 18 receive the first deferral already at school and can continue to study at this level until the age of 20. In this case, they have only one deferment left to receive further professional education.

In connection with the increase in the spring conscription campaign, the General Staff advises 18-year-old school graduates to have time to enter the university before July 15, since deferrals from the army do not apply to applicants.

However, some students still have a chance to avoid the army. According to experts, if an 18-year-old graduate used a "learning" deferment at school and he manages to enter a university without joining the army, then he will have every right to a second deferment to study at the university. This is clearly indicated by paragraph 2 of Art. 24 of the law "On military duty and military service".

As for the "gap" between graduation from school and entering a university, during this period no deferrals are valid, and a criminal case can be initiated against a young man for draft evasion (Article 328 of the Criminal Code of the Russian Federation).

However, if a young person still manages to enter a university before the conviction for evasion is passed, then he is exempted from criminal punishment “due to a change in the situation” - since he already has the right to a deferment. It is recommended that courts do this in the decision of the Plenum of the Supreme Court of the Russian Federation dated 03.04.2008.

To apply for exemption from conscription for military service in accordance with Article 23 of the Federal Law "On military duty and military service", the conscript must submit all the necessary documents confirming the right to exemption from conscription (Sample applications: sample 1; sample 2).

It is important to know that the conscript will not be granted a deferment from military service for study until he has been examined for health reasons. Therefore, in cases where certificates from educational institutions are brought to the draft board by mothers or other relatives of recruits, the decision to postpone may not be made, since the draftee himself did not appear at the draft board for a medical examination, and he can automatically be included in the list of "evaders". and will be held liable in accordance with the law.

In February 2010, the State Duma submitted amendments to the law "On military duty and military service" for consideration by the State Duma, suggesting that school graduates who are 18 years old not be called up for the "spring draft".

The document proposes to give a deferment to such 18-year-old graduates until the fall (until October 1). At the same time, this will affect children who turn 18 before July 16. Spring conscription runs from April 1 to July 15, and autumn - from October 1 to December 31.

The explanatory note notes that the spring conscription partly coincides with the entrance exams to universities. The authors of the amendments believe that 18-year-olds who have graduated from school are actually limited in their right to enter an institute.

In practice, employees of military enlistment offices get the opportunity to resolve issues of conscription at their own discretion, which creates the prerequisites for corruption.
